According to The New York Times, Madonna lost her lawsuit to stop the auction of  “extremely private and personally sensitive” items including a breakup letter from her former boyfriend Tupac Shakur, a brush with strands of her hair and a pair of satin underwear. The items are to be sold by a former friend of the pop star.

In the letter from the “Dear Mama” rapper, he explained how Madonna dating a Black man would be beneficial to her career.

“For you to be seen with a black man wouldn’t in any way jeopardise your career, if anything it would make you seem that much more open and exciting,” Shakur wrote. “But for me at least in my previous perception, I felt due to my ‘image’ I would be letting down half of the people who made me what I thought I was.”

Gerald Lebovits, a New York Supreme Court judge had allowed a preliminary injunction to block Darlene Lutz from selling the 22 items in July 2017. However, Justice Lebovitz dismissed the case on Monday because the statute of limitations to get the items back had expired. Lutz was Madonna’s personal assistant, and the singer claims she didn’t know she was in possession of the letter until the online auction launched.

Unfortunately for Madonna, she and Lutz settled a legal dispute in 2003 over artwork. In that case, Madonna signed a release of “any and all” future claims against Lutz. Judge Lebovitz pointed toward that case when making his ruling on April 23.

The auction house will move forward with the sale of the items in July. The bid for the letter from Tupac will start at $100,000.
