President Donald Trump wants to issue an executive order removing the right to citizenship for U.S. born babies of parents who aren’t citizens.
In an interview with Axios on HBO, Trump said he could make the change through executive order, bypassing Congress.
“It was always told to me that you needed a constitutional amendment. Guess what? You don’t,” he said. “You can definitely do it with an act of Congress. But now they’re saying I can do it just with an executive order.”
An executive order outlawing birthright citizenship would be in direct conflict of the 14th Amendment of the U.S. Constitution, which states “All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States.”
“We’re the only country in the world where a person comes in, has a baby, and the baby is essentially a citizen of the United States for 85 years with all of those benefits,” he said.
The president’s claim is false as at least thirty countries offer citizenship to people born within their borders, according to PolitiFact.
Trump expressed interest in ending birthright citizenship in 2015 during his campaign for president, writes HuffPost.
“I don’t think they have American citizenship and if you speak to some very, very good lawyers — and I know some will disagree — but many of them agree with me and you’re going to find they do not have American citizenship. Our country is going to hell,” he told CNN in an interview at the time.
